About licensed fishing on the Varkaļi Canal

Article 10, fifth paragraph
- The binding regulations prescribe the procedures for organising licensed fishing in the fishing zone of the Varkaļi Canal located in the administrative territory of Jurmala State City.
- Licensed fishing in the fishing area of the Varkaļi Canal shall be organised in accordance with the by-law on licensed fishing in the Varkaļi Canal developed by the association “Environmental Protection Association” and co-ordinated in accordance with the procedures stipulated by the Cabinet (in annex)).
- The Binding Regulation No. 53 of the Jurmala City Council of 19 December 2019, On Licensed Fishing in the Varkaļi Canal, is repealed.

Bylaws for Licensed Fishing
In the Varkali Canal
I. General Provisions
1. The by-law regarding licensed fishing in the Varkaļi Canal (hereinafter – the By-law) shall determine the procedures for licensed fishing on the Varkaļi Canal in the administrative territory of Jurmala State City, the possessor of which, in accordance with Section 15, Paragraph two of the Land Management Law , is the municipality of Jurmala State city
2. On the basis of the Jurmala City Council Binding Regulations No. 53 of 19 December 2019 (prot. No. 16, p. 16) “On the organization of licensed fishing, fishing and underwater hunting in the Varkaļi Canal” and the authorisation agreement No. 1.2-16.11/905 of June 13, 2019, licensed fishing in the place indicated in Paragraph 4 of the By-laws is organized by the association “Environmental Protection Association”, registration number: 50008135431, address: Saules iela 18, Kegums, Ogre district, LV-5020, contact phone +37129411377, e-mail: atbalsts@inspektori.lv (hereinafter – the organizer of licensed fishing).
3. Licensed fishing in the Varkaļi Canal, where fishing is permitted in accordance with Cabinet Regulation No. 800 of 22 December 2015, Regulations Regarding Fishing, Fishing and Underwater Hunting (hereinafter – Cabinet Regulation No. 800), shall be introduced on the basis of Section 10, Paragraph five of the Fisheries Law and Cabinet Regulation No. 799 of 22 December 2015 “Procedures for Licensed Fishing, Fishing and Underwater Hunting” (hereinafter – Cabinet Regulation No. 799) Sub-paragraph 5.2 in order to organise fishing of a limited amount in the waters of the Varkaļi Canal indicated in Paragraph 4 of the By-laws, limiting the extraction of valuable fish, regulating the number of anglers, replenishing fish resources, protecting them and developing the infrastructure of the fishing place.
II. Licensed Fishing Regulations
4. The place of licensed fishing is a section of the Varkaļi Canal in the territory of Jurmala State City, which connects Babite Lake with lielupe. The boundaries of the licensed fishing ground are indicated in the scheme to the Regulations in accordance with the description of the connecting lines of the following points specified in the scheme:
4.1. from point 1 (GPS: 56.956449, 23.834969) to point 2 (GPS: 56.959264, 23.832523) – from the border of Jurmala State city along the shoreline of the Varkaļi Canal to the mouth of the canal in Lielupe;
4.2. from point 2 (GPS: 56.959264, 23.832523) to point 3 (GPS: 56.958703, 23.830582) – 100 metres along the bank line of lielupe towards the stream;
4.3. from point 3 (GPS: 56.958703, 23.830582) – to point 4 (GPS: 56.959988, 23.829684) – 100 metres perpendicular to the right bank line of lielupe;
4.4. from point 4 (GPS: 56.959988, 23.829684) to point 5 (GPS: 56.961824, 23.836627) – a line departing from point 4 in the direction along the Lielupe stream 330 metres to the connection with point 5;
4.5. from point 5 (GPS: 56.961824, 23.836627) to point 6 (GPS: 56.960580, 23.837436) – 100 metres perpendicular to the right bank line of the Lielupe River to the junction with it;
4.6. from point 6 (GPS: 56.960580, 23.837436) to point 7 (GPS: 56.960098, 23.835670) – 100 metres along the bank line of lielupe towards the stream;
4.7. from point 7 (GPS: 56.960098, 23.835670) to point 8 (GPS: 56.956719, 23.837493) – along the coastline of the Varkaļi Canal to the border of Jurmala State city;
4.8. from point 8 (GPS: 56.956719, 23.837493 to point 1 (GPS: 56.956449, 23.834969) – interconnected perpendicular to the shoreline of the Varkaļi Canal.
5. Fishing in the place indicated in Paragraph 4 of the By-laws shall take place throughout the year in accordance with the requirements laid down in Cabinet Regulation No. 800, observing the following additional conditions:
5.1. during the spring period (from 1 March to 31 May) it is prohibited to use spinning with artificial or natural bait fish in fishing;
5.2. from the total permitted number of fishing rods (two fishing rods) it is prohibited to use more than one fishing rod with natural bait fish or a separated piece thereof for fishing;
5.3. it is prohibited to leave any fishing gear unattended, moving away from fishing gear further than 25 metres;
5.4. it is prohibited to fish and engage in underwater hunting at the place of licensed fishing;
5.5. it is not allowed to fish from the parking lot of the highway crossing the Varkaļi Canal, shore supports, bridge and sluice structures.
6. Licensed fishing is carried out from the shore using a 10-meter towpath, from ice and from a boat.
III. Types of Licences, Fee and Number of Licences
7. Fishing in the territory specified in Paragraph 4 of the Regulations shall be permitted by purchasing one of the following licences:

* The licence also gives the right to fish from the shore or from ice (the licence specified in Paragraphs 7.3 and 7.4 of the Regulations)
8. The licences indicated in Sub-paragraphs 7.2, 7.4, 7.6, and 7.8 of the Regulations are entitled to purchase:
8.1. children and adolescents up to 16 years of age;
8.2. persons over 65 years of age;
8.3. persons with disabilities;
8.4. politically repressed persons;
8.5. owners of coastal lands of the licensed fishing place and their family members;
8.6. persons from large families and families in the care of whom there is a child with a disability or an adult person who has not reached the age of 24 years, if disability group I or II has been determined for him or her, and who have been granted an Honorary Family Card of Latvia in accordance with the Latvian Honorary Family Card programme implemented in the State.
9. When purchasing licences for a reduced fee, the persons indicated in Paragraph 8 shall present a personal identification document to the organiser of the licensed fishing and/or representatives of the authorities for the protection and supervision of fish resources and in addition:
9.1. the persons indicated in Sub-paragraphs 8.3 and 8.6 of the Regulations – aged from 16 to 65 years – a disability certificate and/or an Honorary Family Certificate of Latvia;
9.2. the persons indicated in Sub-paragraph 8.4 of the Regulations aged from 16 to 65 years – a politically repressed identity card;
9.3. The persons indicated in Sub-paragraph 8.5 of the By-laws – a copy of the land register certificate regarding the ownership of the land owner for the coastal land of the licensed fishing territory.
IV. Content, Presentation and Marketing of Fishing Licences
10. A fishing licence shall contain the following details:
10.1. the name and type;
10.2. the sequence number;
10.3. the expiry date;
10.4. the licence price;
10.5. the details of the organiser of fishing;
10.6. the given name, surname, personal identity number, telephone number and electronic mail address to be used for communication of the recipient;
10.7. the date of issue.
11. A licence with corrections shall be considered invalid.
12. All licences shall be prepared and issued electronically according to their types and prices and registered in accordance with the procedures laid down in laws and regulations.
13. Fishing licences may be purchased on the website www.manacope.lv.
14. All licence holders shall be electronically registered by indicating the given name and surname, for the creation of the licensed fishing database and for the analysis of the sale of licences.
V. Utilisation of the Funds Obtained in the Implementation of Licences
15. The organiser of licensed fishing shall, once every six months, by 10 July for the first half-year and by 10 January for the second half-year, transfer 20 % of the funds obtained from the sale of fishing licences to the State basic budget for the formation of the Fish Fund.
16. The organiser of licensed fishing shall use 80 % of the total amount obtained in the marketing of licences for the organisation of licensed fishing, replenishment of fish stocks, protection thereof and development of the infrastructure of the fishing site.
VI. Procedures for Recording the Catches of Anglers
17. All anglers must submit to the www.manacope.lv on the website an electronic catch report of a specific sample found on this website, but not later than five days after the expiry date of the fishing licence.
18. The catch report shall be submitted electronically also in cases where the catch has not been taken/retained or the licence has not been used.
19. If the angler has purchased the licence himself or herself from his or her user profile on the website www.manacope.lv , the catch report of the licence shall be transferred from the section “My purchases” (if the licence has not expired) or “Purchase history” (if the term of validity of the licence has expired) of the user profile of this website.
20. If the license has been purchased by another person for the angler, the license catch report must be submitted using the link provided in the license purchase email for submitting the catch report.
21. The organiser of licensed fishing shall register persons who have violated the procedures for recording catches specified in the By-laws and, using the telephone number or electronic mail address indicated in the licence, shall notify of the necessity to submit a catch report within 14 (fourteen) days. If the catch report is not submitted within that time limit, the organiser shall inform the authorities for the protection and management of fishery resources of the infringement found.
22. The organiser of licensed fishing shall, by 1 February of the following year, submit to the State scientific institute Institute of Food Safety, Animal Health and Environment “BIOR” (hereinafter – the Institute) a report on the types of licences implemented, the number and the catches of anglers obtained for the previous year on the basis of the data of the submitted licences.
VII. Duties and Responsibilities of the Organiser of Licensed Fishing
23. In addition to that specified in the Cabinet regulations, the organiser of licensed fishing has the following obligations:
23.1. to ensure the availability of fishing licences in accordance with Paragraph 13 of the By-laws;
23.2. to register persons who have violated the procedures for recording roles specified in the By-laws;
23.3. to list and implement fishing licences in accordance with the requirements laid down in laws and regulations;
23.4. to ensure the utilisation of the funds obtained by implementing fishing licences in accordance with Chapter V of the By-laws;
23.5. to keep records of the catches of anglers in accordance with the procedures laid down in Chapter VI of the By-laws and to provide information to the Institute in accordance with Paragraph 22 of the By-laws;
23.6. to ensure cleaning of the environment in a 10-metre-wide coastal strip at the licensed fishing place, co-ordinating the frequency of cleaning with the local government of the State city of Jurmala;
23.7. to submit a report to the Rural Support Service on the number of fishing licences implemented and the types of licences, the funds obtained and the utilisation thereof twice a year – for each previous half-year – by 15 July and 15 January respectively;
23.8. to list the licences sold on the website www.manacope.lv in chronological order electronically for each half-year and, after the end of each half-year, to make a printout of the list of licences electronically listed in the relevant half-year, ensuring storage of the printed lists of licences together with the licence accounting journal;
23.9. to determine the responsible person who has acquired the status of a public environmental inspector or an authorised person of the local government and participates in measures for the protection and supervision of the environment and fish resources;
23.10. each year by 31 December to submit to the State Environmental Service a report on the measures taken for nature protection, control and replenishment of fish resources (if it is provided for), as well as information regarding the establishment and maintenance of the infrastructure necessary for the organisation of licensed fishing in accordance to Cabinet Regulation No. 799, co-ordinating the report with the Administration of the State City of Jurmala prior to submission;
23.11. to place informative signs regarding licensed fishing in the Varkaļi Canal;
23.12. to inform anglers, crayfishers or underwater hunters regarding public access points in the body of water in which licensed fishing is organised;
23.13. to provide foreign tourists with information in English and/or Russian or, if necessary, also in the language of other neighbouring countries of Latvia, regarding the possibilities of communication with the organiser, the regulations for licensed fishing, the types, number of licences, their fee, as well as record-keeping of catches;
23.14. to replenish fish stocks in Lielupe, if it is intended in accordance with the recommendations of the Institute.
24. The organiser of licensed fishing shall not be liable for compliance with the personal safety measures of anglers when fishing from shore, boat or ice, as well as for compliance with other requirements laid down in laws and regulations which do not apply to the essence of this Regulation.
VIII. Plan of Events of the Organiser of Licensed Angling for the Conservation, Replenishment, Protection of Fish Resources and Control of Requirements
25. The organiser of licensed fishing, taking into account the scientific recommendations and results of fish surveys, the needs for the protection of the environment and fish resources, shall develop and implement a plan of measures for the restoration, supplementation and protection of fish resources at the licensed fishing site in the Varkaļi Canal from 1 January 2023 to 31 December 2027, which includes:
25.1. to restrict edge fishing, to control compliance with the laws and regulations governing angling and to check fishing licences;
25.2. to ensure regular cleaning of the licensed fishing territory, the Varkaļi Canal and the adjacent Lielupe towpath;
25.3. according to the revenue from the licensed angling and recommendations of the Institute to participate in measures for the replenishment of fish stocks and the protection of natural spawning.
26. Compliance with the by-laws shall be controlled by the authorities referred to in Section 18 of the Fisheries Law, as well as the persons referred to in Section 20 of the Fisheries Law shall participate in the supervision thereof.
IX. Annexes to the Regulations
27. The following annexes shall be appended to the by-laws:
27.1. the place of licensed fishing (Annex 1);
27.2. Samples of licences (Annexes 2 to 9);
27.3. Co-ordinations of the Regulations (Annex 10).
